The 3DS version was already finished and moving into manufacturing (cartridges take longer to produce) by the time the deal was signed with WB & Nintendo.

As it was blindingly obvious, Legend of Zelda and Mario characters have been confirmed for Scribblenauts Unlimited. The characters pictured above will be exclusively available in the Nintendo Wii U version of the game, sorry 3DS fans.
Here are two images from AGB that tease the inclusion of Nintendo characters in the upcoming game, Scribblenauts Unlimited. The title is set to be released on Nintendo Wii U/3DS and is seemingly going to include Paper Mario characters as well as Legend of Zelda characters. Awesome stuff!
